Submit a Privacy Request

FDIC accepts privacy complaints in connection with the Corporation’s handling of personal information, including the collection, use, sharing, or retention, or any other concerns regarding the impact of the FDIC operations on privacy. If you have questions or complaints, you can contact the Privacy Program Section Chief.

The complaint process is separate from access and amendment procedures under the Privacy Act. Go to “Privacy Act Request” for information on accessing or amending an FDIC record containing your personal information.

If you have a complaint or question about FDIC-supervised institutions, please submit a complaint to the FDIC Information and Response Center.

Background

In accordance with the Privacy Act, the FDIC maintains information about individuals in its Systems of Records, and permits those individuals to access or correct information about themselves from those systems. A System of Records is a group of any records under the control of the Corporation from which information is retrieved by the name of the individual or some identifying number, symbol or other identifying particular assigned to the individual. Note that not all information is maintained in a System of Records.

Privacy Act Requests

The FDIC processes Privacy Act Requests similar to Freedom of Information Act Requests; accordingly, an individual can submit a Privacy Act Request as outlined in the FDIC Privacy Act Regulations or through the FOIA request process. For each request, please provide the following:

1. Proof of Identity– Please provide us with proof of identity to protect the individual to whom the information being sought pertains. FDIC requires a copy of your photo ID, such as a driver's license, AND EITHER
   
   • a Certification of a Duly Commissioned Notary Public, of any state or territory, attesting to your identity
     OR
   • an unsworn declaration subscribed to as true under the penalty of perjury under the laws of the United States of America.

   FDIC may also require minimal identifying data such as full name, date and place of birth, or other personal information necessary to ensure proper identity before processing requests for records.

2. Records that You Seek – Please provide us with a complete description of the FDIC records you would like to obtain.  Please do not use broad or ambiguous phrases such as “any and all.”  If you know when the records were created, tell us; if you’re not sure, suggest a reasonable time period. Include the name of the appropriate designated system and category. For a list of FDIC systems, see System of Records Notices (SORNs).
3. Detailed Background about the Records – Please include any additional information that will help us to locate the records you seek.  You can submit additional documentation.
4. Reason for Amendment and/or Correction – If you are requesting an amendment to a record, please provide a reason for the request.

FDIC acknowledges receipt of Privacy Act requests typically within ten business days of receipt, and will notify you whether any System of Records contains a relevant record, and whether the request for access will be granted or denied. If granted records will be disclosed to the individual as soon as practicable. If your request is denied, FDIC will provide you an explanation for denial and outline the procedures you can follow if you choose to appeal the decision.

To appeal a FDIC determination on an access or amendment request, submit your appeal in writing within 30 business days following receipt of notification of denial. Include the following with your appeal:

• All information specified for request for access or initial request to amend – See the description provided above.
• Provide any other additional information you think relevant for consideration by the General Counsel.
