We appreciate the opportunity to comment on the proposed guidance on Garnishment of Exempt Federal Benefits Funds.

Kansas law specifically states it is the responsibility of the depositor receiving the garnishment to make the claim that funds being garnished are exempt from garnishment. We believe the law should remain as it is. Bank staffs are already stretched thin due to the requirements of other regulations, and expecting these same personnel to “police” each deposit account is beyond comprehension.

Please consider these comments in your final decision on this proposal.
