4611. QUALIFICATION REQUIREMENTS FOR THE RECOMMENDATION OR SALE OF
CERTAIN SECURITIES

Abstract: This proposal, sponsored jointly by the OCC, the FRS, and the
FDIC, would establish qualifications for banks that sell certain
securities to their customers without having to register as a broker
under the Securities Exchange

Act. FDIC staff are contemplating a recommendation to rescind this
proposal and replace it with a second NPRM to exempt banks from
registering with the NASD/SEC as securities brokers or dealers in the
event that they qualify under any of the exemption criteria in Gramm-
Leach-Bliley Act sections 201 or 202 (see NPRM described at 3064-AC42).
