ORDER TERMINATING PROCEEDING AND RESCINDING ORDER OF SUSPENSION AND PROHIBITION
WHEREAS, a Notice and Order of Suspension and Prohibition ("Order") was issued on December 9, 1993, by the Federal Deposit Insurance Corporation ("FDIC") against Brett E. Morehouse ("Respondent"), as an institution-affiliated party of Citizens Bank & Trust of Kansas City, Kansas City, Kansas ("Bank"), under section 8(g) of the Federal Deposit Insurance Act, 12 U.S.C. § 1818(g), and based upon an indictment, suspending and prohibiting Respondent from further participation in any manner in the conduct of the affairs of the Bank; and
WHEREAS, Respondent waived the right to a hearing, under 12 C.F.R. § 308.164(c), and requested that this matter be submitted on the written record; and
WHEREAS, the Presiding Officer considered the parties' written submission and issued a Recommended Decision which urged that the FDIC Board of Directors ("Board") rescind the Order; and
WHEREAS, FDIC Enforcement Counsel requested termination of this proceeding as moot since the indictment upon which it was based will be dismissed.
NOW, THEREFORE, the board having considered the record and the applicable law, finds and concludes that the Order is hereby rescinded and this proceeding is DISMISSED as moot.
