   The Federal Deposit Insurance Corporation ("FDIC") issued a NOTICE OF ASSESSMENT OF CIVIL MONEY PENALTIES, FINDINGS OF FACT AND CONCLUSIONS OF LAW, ORDER TO PAY, AND NOTICE OF HEARING ("NOTICE OF ASSESSMENT") on September 12, 1991, against Timothy T. Thomason, Emil Accornero, Gerald S. Feagley, Joseph R. Mariotti, Thomas M. Powers, John Roveda, Maurice Sandler, and Joseph Sindicich ("Respondents"), assessing civil money penalties for violating section 18(d)(1) of the Federal Deposit Insurance Act, 12 U.S.C. § 1828(d)(1).
   Following the issuance of the NOTICE OF ASSESSMENT, Respondents and the FDIC executed a STIPULATION AND AGREEMENT TO PAY ("STIPULATION") in which Respondents agreed to pay the following civil money penalties within ten (10) days of the issuance of an AMENDED ORDER TO PAY ("AMENDED ORDER"): Timothy T. Thomason, six thousand dollars ($6,000); Emil Accornero, three thousand dollars ($3,000); Gerald S. Feagley, three thousand dollars ($3,000); Joseph R. Mariotti, three thousand dollars ($3,000); Thomas M. Powers, six thousand dollars ($6,000); John Roveda, three thousand dollars ($3,000); Maurice Sandler, three thousand dollars ($3,000); and Joseph Sindicich, three thousand dollars ($3,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Timothy T. Thomason, be, and hereby is, amended to provide that Timothy T. Thomason be, and hereby is, assessed a penalty of six thousand dollars ($6,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Emil Accornero be, and hereby is, amended to provide that Emil Accornero be, and hereby {{8-31-94 p.C-2387}}is, assessed a penalty of three thousand dollars ($3,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Gerald S. Feagley be, and hereby is, amended to provide that Gerald S. Feagley be, and hereby is, assessed a penalty of three thousand dollars ($3,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Joseph R. Mariotti, be, and hereby is, amended to provide that Joseph R. Mariotti be, and hereby is, assessed a penalty of three thousand dollars ($3,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Thomas M. Powers, be, and hereby is, amended to provide that Thomas M. Powers be, and hereby is, assessed a penalty of six thousand dollars ($6,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent John Roveda, be, and hereby is, amended to provide that John Roveda be, and hereby is, assessed a penalty of three thousand dollars ($3,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Maurice Sandler, be, and hereby is, amended to provide that Maurice Sandler be, and hereby is, assessed a penalty of three thousand dollars ($3,000).
   IT IS HEREBY ORDERED, that the NOTICE OF ASSESSMENT issued on September 12, 1991, as to the Respondent Joseph Sindicich, be, and hereby is, amended to provide that Joseph Sindicich be, and hereby is, assessed a penalty of three thousand dollars ($3,000).
   IT IS FURTHER ORDERED, that the reduced civil money penalties must be paid in full within ten (10) days of the issuance of this AMENDED ORDER. Should said reduced civil money penalties not be paid within that time frame, the AMENDED ORDER shall become null and void, and the original NOTICE OF ASSESSMENT shall be reinstated assessing civil money penalties against Respondents in the following amounts: Timothy T. Thomason, ten thousand dollars ($10,000); Emil Accornero, five thousand dollars ($5,000); Gerald S. Feagley, five thousand dollars ($5,000); Joseph R. Mariotti, five thousand dollars ($5,000); Thomas M. Powers, ten thousand dollars ($10,000); John Roveda, five thousand dollars ($5,000); Maurice Sandler, five thousand dollars ($5,000); and Joseph Sindicich, five thousand dollars ($5,000).
