Appeals of Material Supervisory Determinations: Guidelines & Decisions

SARC- 96-03 (March 22, 1996)

The Supervision Appeals Review Committee (“Committee”) of the Federal Deposit Insurance Corporation (“FDIC”), on March 21, 1996 considered the appeal filed on your behalf by Mr. … of Law Firm and concluded that the findings with respect to certain alleged violations of Regulation O, as cited in the May 15, 1995, Report of Examination, are appropriate.  Due to Mr. Y’s guarantee of the extensions of credit to his related interests, these loans are within the purview of Regulation O.  Also, … has been determined to be a related interest for purposes of Regulation O.

Pursuant to FDIC guidelines, the scope of the Committee’s review was limited to the facts and circumstances that existed at the time of the examination.

This determination is considered a final supervisory decision of the Federal Deposit Insurance Corporation.

By direction of the Supervision Appeals Review Committee of the FDIC.
